Terms of use of gift cards of multifunctional shopping and entertainment centers “AKROPOLE Rīga” and “AKROPOLE Alfa”

  1. These rules are valid from 01.01.2024.
  2. This document contains the terms of use of Gift Cards of the Multifunctional Shopping and Entertainment Centre “AKROPOLE Rīga” (located in Riga, Maskavas iela 257) and “AKROPOLE Alfa” (located in Riga, Brīvības gatvė 372).
  3. Card – a non-personalised, non-renewable prepaid card (data carrier) containing a predetermined value which the Cardholder has paid as a prepayment, which, duly paid in advance, enables the Cardholder to pay for purchases (goods and services) in a limited network, i.e. in shops operating in the multifunctional shopping and entertainment centres “AKROPOLE Riga” or “AKROPOLE Alfa” and marked with a special sign or information notice (hereinafter referred to as “Partners”).
  4. Cards as a payment instrument are issued by Lieliska dāvana SIA (hereinafter also referred to as the Issuer or the Administrator) as an exceptional payment service provider entitled to provide the payment service referred to in Article 10(3)(c) of the Payment Services and Electronic Money Law (https://uzraudziba.bank.lv/en/market/payment-service-providers/exceptions/sia-lieliska-davana/).
  5. M257 SIA and Delta Property, SIA (hereinafter referred to as the “Distributor”), legal entities authorised by the Issuer, distribute the Cards in the Information Centres (Multifunctional Shopping and Entertainment Centres “AKROPOLE Riga” and/or “AKROPOLE Alfa” Information Centres) on behalf of and may represent the Issuer in relations with natural and legal persons who purchase the Cards (hereinafter referred to as the “Purchasers”).
  6. Lieliska Dāvana Ltd., in accordance with the agreements concluded by the Distributors, technically services and administers the Card distribution programme implemented by the Distributor – organises the distribution of the Cards, organises the provision of additional services related to the distribution of the Cards to persons holding a Card (hereinafter referred to as “Card Users”) and is a legal entity which may represent the Distributor in its relations with Card Users and Purchasers. The Administrator shall act on behalf of the Distributor.
  7. The Issuer shall manufacture and issue Gift Cards and perform other activities as provided for in these Terms and Conditions.
  8. The Card Distribution Programme shall be implemented in accordance with the following provisions. Related Obligations and Rights.
    1. The Card Distribution Rules are published on the Internet at https://akropoleriga.lv/, https://akropolealfa.lv/ and at the Card Distribution Points.
    2. The Cardholder must read these Card Terms and Conditions before purchasing the Card.
    3. By purchasing a Card, the Purchaser becomes a Card User and by purchasing a Card confirms that he/she has read, accepts and agrees to be bound by these Card Terms and Conditions.
    4. The Cardholder, by transferring the Card to another person (by gift, sale, etc.), undertakes to inform this other person (future Cardholder) of these Card Terms and Conditions.
    5. The person who has taken over the Card shall become the Card User and shall acknowledge that he/she has read, accepts and agrees to be bound by these Card Terms and Conditions.
    6. The Card is not personalised, any person in possession of the Card shall be deemed to be a Card User.
  9. Cards shall be sold to Customers and additional services related to the distribution of Cards to Card Users shall be provided by a company having a dedicated Customer Service Point (hereinafter referred to as the “Card Distribution Point”) and operating under an Agreement concluded with the Distributor and the Administrator (hereinafter referred to as the “Card Vendor”). The Card Vendor shall act on behalf of the Issuer.
  10. The Card is reusable, i.e. the amount of money contained therein may be used several times at different Partner Stores as long as the face value of the Card is not exhausted or the Card has not expired.
  11. The Card shall bear and/or store the following information: the Card name, identification number (represented by numbers, graphic codes) and other information necessary to properly inform the Customer or to perform the functions of the Card.
  12. The Card may display and/or store the following information: the value of the Card (denomination), the beginning and the end of the validity period of the Card. If this information is not indicated on the Card, it may be obtained free of charge at the Card Distribution Point, https://www.akropoleriga.lv, https://akropolealfa.lv/ or by scanning the QR code with a smartphone.
  13. The Card shall be valid and usable from the moment it is issued to the Purchaser and the Purchaser has paid its face value.
  14. The Card can be purchased online at www.akropoleriga.lv, https://akropolealfa.lv/ or www.lieliskadavana.lv and at other Card distribution points. Information on the Distribution Points is available on the Distributor’s website at https://akropoleriga.lv or https://akropolealfa.lv/,.
  15. When purchasing the Card online via the Internet and opting for delivery by e-mail, the electronic Card will be sent to the e-mail address of the Purchaser. An electronic Gift Card purchased online and still valid and unused may be exchanged for a regular Card at the Card Points of Distribution at the request of the Purchaser/Card User.
  16. Self-Service – the website www.akropoleriga.lv, https://akropolealfa.lv/ or https://www.lieliskadavana.lv/pasapkalposanas where the Card User can check the balance and expiry date of the Card by entering the necessary identification data (number and/or barcode).
  17. Card QR code – a black dotted two-dimensional grid on a white background, which can be scanned with a smartphone using a special application (free downloadable app QR code reader), after which the Card balance and expiry date are displayed.
  18. A newly purchased Card is valid for 6 (six) months from the date of purchase. In exceptional cases (promotions, etc.), longer validity Cards may be issued.
  19. Taking into account the privacy of the Card user, information about the Card user is not collected, used for promotional purposes or passed on to third parties without his/her consent, however, such information may be requested if it is required by law and the Card user/buyer is obliged to provide it.
  20. Cards are sold/issued with a denomination of value, the amount of which may be selected by the Purchaser to the nearest 0,01 €, starting from a minimum amount of 10 € up to a maximum of 150 €. In special cases (promotions, etc.) other non-standard denominations of Cards may be issued, but in any event up to a maximum of €150.
  21. The Card purchased and the additional services provided by the Card Distributor may be paid for in cash or by prepayment, by bank transfer (if the Card Distributor is able to accept payment by bank transfer) or by any other means available at the Card Distributor. The payment methods available at the Card Distribution Facility for the sale of Cards and for additional services related to the distribution of Cards may not be compatible with the payment methods available for other goods or services (e.g. Cards cannot be paid for by bank card, etc.).
  22. Purchase documents:
    1. No VAT invoice will be issued upon purchase of the Card(s). At the Purchaser’s request, a Gift Card Acceptance Deed shall be issued.
    2. At the Buyer’s request, the Gift Card Acceptance Deed for Gift Cards and/or the VAT invoice for goods and services related to the distribution of Gift Cards may be provided only in electronic form to the e-mail address provided by the Buyer.
    3. No other information shall be sent to the e-mail address provided by the Buyer unless the Buyer is on the Distributor’s or Administrator’s newsletter subscriber list.
    4. The acceptance transfer deed shall specify the name, number and amount of the Cards purchased, the VAT invoices shall specify the goods selected, their quantity, discounts, the final price of the goods including all taxes and other data required by the accounting legislation.
  23. The Cardholder may use the following additional services related to the distribution of the Cards:
    1. Extension of the validity period of the Card. The service is provided at www.akropoleriga.lv, https://akropolealfa.lv/ and/or https://www.lieliskadavana.lv/pasapkalposanas by entering the details of the Card or at Card distribution outlets by presenting the Card or the contact details attached to the Card in the following order:
      1. Extensions may be granted for a Card that has not yet been used or has been partially used, may be expired or may have already expired, but no more than 6 (six) months have elapsed since its expiry date.
      2. The Card may be renewed for an additional period of up to 6 (six) months (from the renewal date), but not more than 12 (twelve) months from the date of sale of the Card.
      3. The Cardholder shall be charged a fee of € 1.45 for each renewal of the Card.
      4. The Card shall not be taken from the Cardholder upon renewal of the Card.
      5. Only the unused balance of the Card is extended.
      6. 12 (twelve) months after the purchase of the Card, the unused balance of the Card is lost, the Card is cancelled and can no longer be used and/or cannot be extended.
      7. After the expiry of the Card usage period, a monthly maintenance fee of € 4.20 shall be charged until the Card balance reaches € 0.00.
        * This clause 23.1.7 applies only to Cards purchased before 31.12.2023.
    2. Redemption of electronic money:
      1. If the Cardholder requests redemption of the electronic money stored in the Card before the expiry date of the Card, a fee of € 10 shall be charged to cover the costs of issuing the Gift Card and the electronic money.
      2. If the Card user requests redemption of the electronic money stored in the Card within 12 months after the expiry of the Card validity period, a fee of € 10 shall be applied to cover the costs of issuing the Gift Card and electronic money.
      3. Electronic money redemption requests may be made by the Cardholder at Card Points by presenting the Card, a valid passport or a valid photocopied or scanned ID card, and the electronic money may only be transferred to the address of an IBAN account opened in his/her name (for anti-money laundering risk reasons, redemption of electronic money in cash or transfer to an account not opened in the Cardholder’s name is not permitted).
      4. Refunds may only be requested and received once and only to the full amount of the Card balance after deduction of applicable fees (if any).* All of Clause 23.2 “Redemption of Electronic Money” applies only to Cards purchased before 31.12.2023.
    3. Replacement of the Card: if the unused Card is damaged but identifiable or requested by the legal user of the Card. The service is provided as follows:
      1. The service is provided on presentation of a valid but unused or partially used Card.
      2. The Cardholder shall be charged €1.45 for each replacement of the Card.
      3. When the Card is replaced, it is taken from the Cardholder (its validity is completely suspended) and a new Card is issued instead.
      4. The validity period of the newly issued Card remains unchanged and the nominal amount (value) is equal to the amount that has not been used for purchases.
      5. When replacing a Card, the identification numbers and the type of Card may change.
    4. Replacement of an Electronic Gift Card with a regular Card. The service is provided in the following order:
      1. The service is provided on presentation of a valid and unused Electronic Gift Card (purchased online and received by e-mail).
      2. The Customer shall be charged € 1.45 for exchanging the Electronic Gift Card for a regular Card.
      3. The Electronic Gift Card can only be exchanged for a new Card.
      4. The Electronic Gift Card will not be returned to the Purchaser upon exchange.
      5. The validity period of the Card remains the same as that of the Electronic Gift Card.
      6. One Electronic Gift Card is exchanged for one regular Card, i.e. it is not possible to exchange one Electronic Gift Card for several Cards or several Electronic Gift Cards for one regular Card.
    5. The Cardholder may present the Card (use the Card) at a Card Distribution Point, Self-Service Portal or Partner Store or present the Contact Information linked to the Card at a Card Distribution Point and receive information on the validity of the Card, unused balance, etc. The service is provided as follows:
      1. The service is provided if the Card is valid and identifiable (the Card is not damaged, it is possible to read/see the identification numbers of the Card).
      2. No fee is charged for providing the information.
      3. Upon provision of the information, the Card shall be returned to the Card User, unless it is suspected that the Card is counterfeit, the use of the Card was carried out criminally or in any way in breach of these Terms and Conditions or applicable laws and regulations.
  24. The Cardholder is responsible for the storage and preservation of the Cards. Lost Cards are not restored and cannot be suspended (blocked) or cancelled. This paragraph also applies to Cards that have been stolen or otherwise unlawfully taken from the Cardholder.
  25. The Card shall not be returned or exchanged for cash.
  26. The Card is the property of the Issuer and may be taken from the Cardholder after the last use of the Card when the Card balance is €0.00.
  27. If the price of the item(s) paid for with the Card exceeds the face value of the Card, the Cardholder may pay the missing amount in addition. If the price of the item(s) paid for with the Card is less than the face value of the Card, only the amount required to pay for the item(s) shall be debited from the Card.
  28. As long as the Card is valid and has the required balance, it can be used for an unlimited number of purchases.
  29. If the Card is not used within 12 (twelve) months from its expiry date (regardless of whether the Card has been modified or its expiry date has been extended), the Cardholder shall be deemed to have been fully provided with the Card Services (under the Card Distribution Programme), the Card shall be cancelled and may no longer be used for the purchase of goods and services.
  30. The Partner has the right not to accept the Card for payment if it is damaged, if it is not possible to scan/read the identification number or if there are reasonable grounds to suspect that the Card is counterfeit. In such case, the legitimate Card User must contact the Administrator and follow the procedures set out in these Terms and Conditions.
  31. If the Card has been used to pay (in whole or in part) for goods and these goods are returned, the Partner (the store where the goods are returned) is entitled to issue another Card for the value of the returned goods. Such new Card may be issued to the Cardholder within seven (7) days of the return of the goods.
  32. If the Card is damaged but can be identified (scanned/read the Card identification numbers), the Cardholder may use the additional services of Card Distribution and replace the Card with a new one.
  33. If the Card is damaged and cannot be identified by its number or barcode, such Card cannot be used, cannot be returned, will not be refunded and the Cardholder will not be provided with additional Card distribution services (Card expiry extension and other services).
  34. From the moment of purchase of the Card, the Cardholder is personally responsible for the security of the Card. Unless the Cardholder decides to transfer the Card to a third party in some form, the Cardholder shall ensure that the Card is in his/her possession only and that the Card identification data (numbers, graphic codes, etc.) are not accessible to third parties (who could counterfeit the Card, use it and/or otherwise harm the Cardholder’s interests by using other people’s Card identification numbers). If the Cardholder becomes aware that his Card identification data may be known to third parties, he must immediately attempt to use the Card for payment purposes, replace the Card or inform the Administrator (by calling +371 6601 8025 AND sending an e-mail to: info@lieliskadavana.lv) immediately, but within 2 hours at the latest, requesting the blocking and replacement of the Card (if its value has not yet been used). The Card User must immediately, but not later than within 2 hours, inform the Administrator (by calling +371 6601 8025 AND sending an e-mail to: info@lieliskadavana.lv) of any unauthorised or improper use of the Card and contact the law enforcement authorities. From the moment of sale/transfer of the Card to the Card User (Purchaser), the Distributor or the Administrator is no longer responsible for the security of the Card, therefore the Card User shall bear all losses.
  35. If the Cardholder violates these Terms and Conditions and/or participates in the Programme in breach of the laws of the Republic of Latvia and/or engages in activities which may be deemed to be intentional damage to the Distributor, the Administrator, Partners, Card Merchants or other participants in the Programme, the Cardholder’s Card may be cancelled and no refund will be made. Such person may be denied new Card sales or additional services related to the distribution of Cards, and law enforcement authorities may be notified of such persons and their activities.
  36. These Card Distribution Terms and Conditions may be amended by giving notice of such amendment no later than 15 (fifteen) days to https://akropoleriga.lv/ or https://akropolealfa.lv/.
  37. Information about the Cards is available on the Internet at https://akropoleriga.lv/, https://akropolealfa.lv/, www.lieliskadavana.lv, by calling the shopping centre “AKROPOLE Riga” at +371 62302150, the shopping centre “AKROPOLE Alfa” at +371 67076500 or “Lieliska DĀVANA” at +371 6601 8025, as well as at the Card distribution points.
  38. Shopping centres “AKROPOLE Rīga” and “AKROPOLE Alfa” may have Partners for whose goods or services it is not possible to pay with the Card. A list of such Partners is available at https://akropoleriga.lv/ or https://akropolealfa.lv/.
  39. The Card may not be accepted as a means of payment if it is suspected to be counterfeit or defective.
  40. If the Gift Card Programme is improperly implemented, the Cardholder or any other interested party shall have the right to submit a written claim in relation to the improper implementation of the Card Distribution Programme. All claims related to the Card and the Programme shall be administered by the Administrator and shall be sent to the following address. The Administrator shall examine the claim within 30 (thirty) days and provide the interested party with a reply at the Administrator’s office, by post, by e-mail or in any other agreed manner.
  41. By purchasing a Card, the Purchaser shall read and enter into the Card Agreement with the Issuer, the Distributor and the Administrator, whereby they confirm that they have read, agree to and are bound by these Terms and Conditions. Card Agreement means these Terms and Conditions, the terms and conditions relating to the Card and the receipt or bill of lading for the purchase of the Card. These Terms and Conditions form an integral part of the Card Contract and as such are binding on all Purchasers and Card Users. The Card Agreement is concluded in a conclusive manner. The Card Contract shall be deemed to be concluded as from the moment the Card is issued to the Purchaser or, in the case of an order for Cards, as from the moment the relevant order becomes binding on the Purchaser, and shall remain in force until the final expiry date of the Card (non-extendable).
  42. The language of communication between the Cardholder and the Parties during the contractual relationship shall be English and Latvian, in the event of any inconsistency the Latvian language shall prevail.
  43. During the term of the Card Agreement, the Cardholder shall be entitled to receive, upon request, information on the terms of the Card Agreement as well as these Terms and Conditions in paper or other durable format.
  44. The Parties agree that the Issuer or the Administrator shall not be obliged to identify and provide information about each use of the Card, its amount and other information in connection with the use of the Card, except for information about the Card balance, as the Card is used on an anonymised basis.
  45. The Card Agreement shall be governed by the laws and regulations of Latvia, and in the event of any disputes in connection with the Card Agreement, by the courts of Latvia.
  46. These Terms and Conditions replace the previous Terms and Conditions of Use of Gift Cards of the Multifunctional Shopping and Entertainment Centres “AKROPOLE Rīga” and “AKROPOLE Alfa”, which were effective from 10.03.2022, and Lieliska Dāvana shall administer and service the Gift Cards issued by UAB Pervesk until 31.12.2023 in accordance with these Terms and Conditions. These Terms and Conditions, insofar as they do not conflict with the Terms and Conditions of the “Gift for a Gift” promotion, shall also apply to the special Akropole Gift Cards of that promotion.
